If you were enrolled in a FSA while you were an active employee working for the State, once you have left the State, retired, RIF, separated, or terminated, and are no longer an active employee, then your FSA account will be closed on the last day of the month of separation/termination. If you had the debit card, the card will be turned off as well. However, you may still file a manual (paper) reimbursement claim for services received during the months you had coverage.
If you choose to take the medical spending account into COBRA, then your eligibility can be continued. Otherwise all claims for services after the end of the month of coverage will be denied and any unused funds are subject to forfeiture pursuit to the rules set up by the IRS under Section 125 plans.
